PHOTO AGREEMENT
1. CANCELLATION/POSTPONEMENT - Photography deposit session fees are NON-REFUNDABLE for cancellation of photography session. Please allow at least 48 hours prior to reschedule.
2. WEATHER - In case of inclement weather, session will be postponed on a scheduled date agreed upon by both photographer and client at no additional charge.
3. COOPERATION/NO SHOWS/LATE ARRIVAL - Photographer is not responsible if client and/or key individuals fail to appear or cooperate during the photography session. If client is more than 15 minutes late for the session, photographer will either take photos for the remainder of the time or will reschedule and client will have to pay 100% of session fee to reschedule the session.
4. COPYRIGHT - All photographs created by Orit Harpaz are copyright protected. It is a violation of federal copyright law to copy, scan or allow photographs that Orit Harpaz has created to be reprinted, duplicated, copied, scanned or altered (digitally or otherwise) without Orit Harpaz’s express written permission. The client agrees to purchase prints directly from Orit Harpaz unless in possession of a disc or digital images with a signed print release form signed by Orit Harpaz. If the client purchases digital images, they understand that they are not given permission to alter the images in any way.
5. LIMITATION OF LIABILITY - While every reasonable effort will be made to produce and deliver the desired images of your session, Orit Harpaz’s liability to the client/s for any damage or loss arising during or after the client’s session, is limited to a reshoot free of charge in substitution for any legal actions. Because of the time spent before, during and after the original session – the sitting fee is non-refundable.
The client understands that they have the opportunity to view all their images prior to ordering any prints, albums, books and other products and that this is their opportunity for determining if they are satisfied with their images or not.
6. MODEL RELEASE - Orit Harpaz has the irrevocable right and permission to use and publish photographs of client, client’s child/ren for the purpose of studio display, portfolio, social media, advertisements, promotions, competitions, web and editorial use. The client understands that their photographs will be used in good taste. The client hereby releases Orit Harpaz from all claims, actions, demands and liability relating to said photographs.
BY SIGNING THIS AGREEMENT, I CONFIRM THAT I AGREE TO ALL TERMS AND CONDITIONS OUTLINED IN THIS AGREEMENT.
